Welcome

These terms are the agreement between you and PhotoMart.ai, operated by Rick Billings, for using photomart.ai. By creating an account or making an image, you agree to them. If you do not agree, please do not use the site.

Your Account

You sign in with a code sent to your email, so keep that email account secure. One account is for one person. You must be 18 or older to create an account on your own. If you are under 18, you may create and use an account only with the permission of a parent or legal guardian, who agrees to these terms on your behalf and takes full responsibility for your account, the photos you add, the images you make and any purchases. Children under 13 may not create an account. We may suspend or close an account that breaks these terms.

The Photos You Add

Only add photos that you have the right to use: photos of yourself, or of someone who has clearly agreed to it. If the person in a photo is under 18, you must be their parent or legal guardian, or be that person and have your parent or guardian's permission. Do not add photos of celebrities, public figures, or anyone else without their permission. You keep ownership of your photos. You give us permission to use them only to make your images and run your account, as described on our Privacy page.

What You May Not Make

Do not use PhotoMart.ai to make nude, sexual, hateful, harassing or violent images, images of children in any inappropriate context, images meant to deceive people about who someone is or what they did, images for identity documents, or anything illegal. We may remove content and close accounts that do.

The Images You Create

The images are made by artificial intelligence from your photo and the style you pick. They are new, generated pictures, and results vary: an image may not look exactly like you, and no two results are the same. Once an image is made for you, you may use it for personal and business purposes, including social media, websites, marketing and print. You are responsible for how you use it.

Credits and Payments

Images are paid for with credits. The number of credits an image costs is shown before you create it, and credits are only taken when your image is made successfully. If something fails on our side, you are not charged. Credits are bought through Stripe, our payment processor; we never see or store your card number. Credits have no cash value and cannot be transferred. Prices and credit amounts may change, but credits you have already bought stay yours.

Subscriptions

If you choose auto-renew, your plan renews every month at the price shown when you subscribed, and your card is charged automatically until you cancel. You can cancel at any time from your Account page, using Manage or cancel subscription. When you cancel, you keep the credits already on your account and you are not charged again.

Refunds

Because credits are used to produce images immediately, purchases are generally not refundable. If you were charged in error, or you are unhappy with a purchase and have not used the credits, email us within 14 days and we will make it right.

Free Credits, Referrals and Giveaways

From time to time we give free credits for joining, sharing, referring friends, or as prizes. These offers can change or end at any time. Accounts created to collect free credits more than once, or any other abuse of an offer, may lose those credits or be closed.

Availability and Changes

We work hard to keep the site running, but we cannot promise it will always be available or free of errors. We may add, change or remove styles and features. We may update these terms; if the change is significant we will post the new date at the top of this page, and continuing to use the site means you accept the update.

Disclaimer and Limits

PhotoMart.ai is provided as is, without warranties of any kind. To the fullest extent the law allows, our total liability for any claim connected to the site is limited to the amount you paid us in the three months before the claim. Nothing in these terms takes away rights the law says cannot be taken away.
